Young cancer patient battling tumor's return

For the last year, we've been following the story of a little boy named Cash Hyde from Missoula. The world has been following, too. Cashy is believed to be the youngest cancer patient in the country whose treatment was being supplemented by cannabis oil. That fact has made his story travel around the world. But, it's Cashy's smile that stays with me. That's why it's heartbreaking to share the news that Cashy's brain tumor has returned.

"Everyone hold your babies close tonight," Cashy's mom Kalli posted on Facebook Friday. "We found out a hour ago that our baby boy cashy is now battling brain cancer again for the third time. Life is so unfair. I'm mad, sad, angry, confused, enraged, and scared to death. Keep him in your prayers please."

Cashy's family has been very forthcoming about his battle. They've risked judgement and even legal prosecution for sharing what they've done for their son. As they told kxly in a special report last year, they made the decision to give Cashy cannabis oil because the cancer drugs were wreaking havoc on his little body. He hadn't eaten in weeks. They gave Cashy the oil without his doctors' knowledge - and, almost immediately, he started to eat and feel better. They believe the oil saved his life and brought back their little boy. They wanted the world to know - and, wanted other patients to have access to cannabis oil. They've taken their message to national media and have received their share of criticism. But, they've always been clear about one thing: they'll do anything to save their little boy's life. Now, sadly, they're facing that battle again.

Hacker suggests that the textbook formulas found in algebra, geometry, and trigonometry classes are rarely used in ?real life,? and the high level of difficulty that many students have with these subjects might unnecessarily inflate dropout rates and cause a handful of other negative educational outcomes. As Hacker suggests, it might be beneficial to focus on the history and philosophy of mathematics or emphasize ?real life? applications of various mathematical fields, rather than zeroing in on the nitty-gritty formulas and minutiae of the math itself. After all, as he acknowledges, one of the most important reasons to learn math is not the math itself ? it is the importance of learning how to engage in deductive reasoning, problem solving, and critical analysis.

However, as fellow science blogger Joanne Manaster noted in a comment about the article, ?I?d argue that perhaps this is not so much about if math is needed, but how it is taught?geometry really helps with logic and thinking skills and algebra with general problem solving, so I don?t think it should go by the wayside altogether.?

I happen to agree enthusiastically with Manaster, and I?d like to hope that Hacker was intending for this larger pedagogical issue to be the main takeaway point for his article. I think it would be a mistake to conclude from this piece that we should simply remove algebra (or any math) from the typical school curriculum, or even that we should replace specific algebra, trigonometry, or geometry classes with broader ?quantitative literacy? courses, as Hacker suggests we should consider at one point. Rather, much as blogger and author Jennifer Ouellette did with calculus in her book The Calculus Diaries, I think the answer lies in finding ways to take this idea of ?real world applications? and using them to?help instructors continue teaching the typical lessons of the algebra, trigonometry, or geometry classrooms in a more effective manner, not using them to replace those lessons.1 Luckily, social psychology offers some theories that can help us understand how students might better learn and understand otherwise-esoteric knowledge.

In a study conducted back in the 1970s, participants were shown 40 trait adjectives (such as outgoing, moody, or adventurous). They were then asked to note either self-irrelevant characteristics of each word (e.g. the font size, sound, or definition of the word) or self-relevant characteristics (e.g. whether or not the word described their personalities). When participants were told to remember as many of the words as possible an hour later, they were significantly more likely to remember the adjectives for which they had answered the self-relevant questions. In other words, adjectives that they processed by thinking about whether or not they applied to themselves were stored better in memory than those that they had processed by thinking about characteristics like their definitions.

Research on this phenomenon, known as the self-reference effect, boils down to one main conclusion ? people are better able to remember events, facts, and knowledge when it is integrated into people?s self-concepts. If you process a speech, fact, problem, or mathematical postulate by personalizing it and applying it to your own life, you?ll be more likely to think about that information, remember it, and recall it later. Integrating information into pre-existing knowledge structures makes it easier to recall, and when it comes to our memory, there is no knowledge structure that is better established than the one containing information about our favorite subject: Ourselves.

But it doesn?t stop there. Not only do we process self-related information better, we understand things better when they?re situated within a social context as well.


As an example, look at the image on the left. Let?s say you need to prove (or disprove) the claim that if a card shows an even number on one face, then its opposite face must be red. Which card(s) must you turn over to test this?

Most people will say that you need to turn over two cards ? the card with the 8, and the solid red card. However, this isn?t correct. In order to test the claim, you do need to turn over the 8 to ensure that the opposite face is red. But, you don?t need to turn over the red card. You need to turn over the green card. You must ensure that the green card does not have an even number on the other side, or else that would invalidate the claim. It doesn?t actually matter what number is on the other side of the red card.

Whether or not you got this correct, the fact of the matter is that most people don?t. In fact, when this experiment was conducted, fewer than 10% of the subjects came up with the correct response. However, what if I asked the question this way?

You walk into a bar. You need to make sure that everyone drinking alcohol is over 21. Each card shown here has a customer?s age on one side, and what he/she is drinking on the other. Which card(s) must you turn over to enforce this rule?

All of a sudden, the answer seems obvious ? and most people quickly figure out the solution. You need to turn over the ?16,? to make sure that the 16-year-old is not drinking beer, and you need to turn over the ?Drinking Beer? card, to make sure that the person drinking it is not underage. It doesn?t matter how old the person drinking soda is, nor does it matter what the 25-year-old is drinking.

This task is exactly the same as the first one ? with one key difference. The latter task involves?social information. The researchers who ran this variation of the first task (formally known as the Wason Card Selection Task) confirmed that when it comes to deductive reasoning, we simply process social information better than other types of knowledge. Once you place the logic test in a bar with underage drinkers, it suddenly becomes easy to figure out its solution.

We?ve now learned that people process, understand, and remember information better when it is presented in one of two ways ? when it pertains to the self, and when it?s situated within a social context. If we can characterize human nature in any universal way, it would be that we are predominantly self-concerned and social creatures. This means that making knowledge relevant to the self or relevant to a social situation should make it easier to understand, remember, and apply.

What?s important to note is that this doesn?t necessarily mean changing the content of the instruction. I think that Hacker is on to something by suggesting that we should be applying all of these mathematical concepts to students? lives, but this doesn?t mean that we have to replace formulas and postulates with applications that are as literal as his suggestions. Making something self-relevant could be as simple as asking students to spend 5 minutes thinking about how they might use a certain mathematical concept in the future jobs they would like to hold or advising students to create mnemonic devices for formulas that incorporate the names of the students? friends and families. Making something socially relevant is simply a matter of creative framing. After all, in the demonstration above with the two card tasks, the second card task was testing the exact same logical reasoning process as the first one ? it simply framed the question differently.

There?s no need to fundamentally alter the content of our mathematics curriculum, even if its current format is flawed. Applying mathematical concepts to people?s ?real lives? does not necessitate throwing the baby out with the bathwater. We can keep teaching current algebra, trigonometry, and geometry content in our schools, and we can even teach them better ? as long as these lessons are constructed with the audience?s two chief concerns in mind.

CT angiography speeds emergency diagnosis of heart disease in low-risk patients

ScienceDaily (July 25, 2012) ? Incorporating coronary CT angiography (CCTA) into the initial evaluation of low-risk patients coming to hospital emergency departments (EDs) with chest pain appears to reduce the time patients spend in the hospital without incurring additional costs or exposing patients to significant risks. The report of a study conducted at nine U.S. hospitals appears in the July 26 New England Journal of Medicine.

"We found that the use of CCTA in emergency department evaluation of acute chest pain very effectively identified which patients did or did not have coronary artery obstruction, allowing clinicians to focus the use of resources on patients with heart disease," says Udo Hoffmann, MD, MPH, director of the Cardiac MR PET CT program at Massachusetts General Hospital (MGH) and corresponding author of the NEJM article. "Although the use of CCTA added to the amount of diagnostic testing used in the evaluation process, compared with current standard protocols it significantly reduced length of stay without increasing costs."

CCTA combines advanced CT scanning with the use of intravenous contrast material to produce detailed images of blood vessels supplying the heart without the need for cardiac catheterization. Several previous studies, including an immediate predecessor to the current one, have indicated that CCTA can effectively distinguish chest pain patients that do not have coronary artery disease, but those studies all had such limitations as lack of a control group or limited analysis of factors like costs and radiation exposure. The current study -- ROMICAT (Rule Out Myocardial Infarction/Ischemia Using Computer Assisted Tomography)-II -- was designed to determine whether a CCTA-based evaluation strategy could improve clinical decision making at different hospitals across the country.

From April 2010 to January 2012, patients arriving at the participating hospitals' EDs for evaluation of chest pain who had no history of cardiovascular disease and whose initial tests -- ECG and measurement of the biomarker troponin -- did not clearly indicate a heart attack were invited to participate in the trial. Those who agreed to participate were randomly assigned to one of two groups. The control group proceeded with standard evaluation, with all diagnostic and treatment decisions being made by hospital physicians not part of the study group. The other group had CCTA as part of their ED evaluation, with the results being shared with attending physicians who, again, made all clinical decisions. Participants who were discharged from the hospital within 24 hours of arrival were called within 72 hours to assess their status, and all participants were called 28 days after hospital discharge and asked whether any return ED visits or rehospitalizations had taken place. Participant responses were verified by checking their medical records. About 1,000 patients completed the study, including the 28-day followup.

The investigators found that participants in the CCTA group had significant reductions in the amount of time from ED arrival until discharge either from the ED or after a hospital stay, with half of the CCTA group being discharged within 8.6 hours but only 10 percent of the control group being released so quickly. The amount of time until a diagnosis of heart disease was either ruled out or confirmed was also shorter for the CCTA group than for the controls, and more patients receiving CCTA were discharged directly from the ED rather than being admitted to an observation unit. The percentage of patients actually diagnosed with heart disease was similar in both groups at around 8 percent, and there were no missed diagnoses in either group.

Analysis of total clinical resources used from arrival to discharge indicated that CCTA participants had more diagnostic procedures than control group members, but the difference was not statistically significant. Neither were there any significant differences between groups in total costs through the 28-day followup in those participants for whom cost information was available. CCTA group participants were exposed to higher cumulative doses of radiation, but the authors note that recent studies have indicated that CCTA can often be successfully performed using lower doses and suggest that future studies test the utility of low-dose CCTA examination.

"It's very important to strive for the greatest efficiency in diagnostic testing, and in this study, additional testing was primarily carried out in patients found to have coronary artery disease," Hoffmann says. "There also were fewer adverse clinical events in those receiving CCTA, although the study group was too small to conclude that CCTA reduced those risks.

"Showing at a variety of clinical sites that CCTA is at least as good as standard ED evaluation without increasing costs elevates the procedure from one appropriate only for specialized settings to one that can be applied in many centers," he adds. "I'd really like to commend the commitment and teamwork of all the participating sites and departments, which was essential to the successful completion of this study." Hoffmann is an associate professor of Radiology at Harvard Medical School.

The route of the self-employed entrepreneur is often touted as one of life?s most difficult paths. But in my experience, it?s been vastly preferable to most ?normal? life paths.?

No, it?s not easy. Yes, it is one of life?s most difficult paths. But unlike other difficult paths, entrepreneurship is something that spreads into all areas of your life. It brings confidence, security and overall satisfaction. So while the work is difficult, the benefits more than make up for it.

?

It?s interesting to see the difference in mindsets.

?

Look at the standard path. College, work, retirement. The mindset of this path is persistence. No, you won?t make a fortune overnight. But over time (if you?re lucky), you?ll be able to make some money and retire on it.

?

But when people switch from the standard path to the entrepreneurial path, they lose that attitude of persistence.

?

?I want retirement in 40 years? becomes, ?I want retirement now.?

?

Aspiring entrepreneurs ask the same questions over and over again. ?How long does it take to make a million dollars?? Persistence no longer exists.?

?

To some degree, I blame the media. After all, they love to show the 21 year old who sells her company for $3,000,000, but they hate showing the amount of work she put in to get there.

?

So people watch TV and think, ?hey, if I start a business, I can be rich overnight too!? This is a mindset that will doom you to business failure ? guaranteed.?

?

The ?statistics? that say starting a business is difficult (9/10 business fail in the first five years) are largely exaggerated. And in the case these statistics are backed by real data, they?re backed by people who have gotten into business with mindsets that?like the one above?guarantee failure.

?

Yes, making large sums of money in business is possible. And yes, you can get it much quicker than if you took the ?traditional? route. But it?s give and take. In order to make this a reality, you need to put in the work necessary. A tall order, to be sure.

?

In this article, we?ll be going over mindsets that can?unlike traditional mindsets?guarantee success.

?

But don?t read too much into that phrase, ?guarantee success.? By doing so, you forget the amount of work involved. You get into business with the idea that you?re guaranteed to be successful. And then when your first business fails, you give up. Looking for guarantees is another mindset that will guarantee failure.

?

It?s a catch-22, I know.

?

Mindset #1: Ideas Don?t Matter

?

?Hello, I have recently come across a billion dollar idea. This is definitely the next Facebook. It?s going to change the world. I need an investment but I?m not sure how to go about it. I don?t want anyone to steal my idea, so I think I?ll have potential investors sign an NDA before they hear it. Maybe I can sell my idea for a million dollars and have someone else invent it.?

?

Your standard aspiring entrepreneur. How many people have you heard say, ?I want to get into business, I just don?t have a good idea.? Probably more than a few.

?

It?s funny ? most people?s perception of business is centered around that big idea. The idea that?ll take them from rags to riches. But in reality, once you have that ?big idea,? you?re just getting started.

?

Seriously.

?

Having an idea is?hands down?the easiest part of business. Execution is what?s hard. Smart execution, turning your idea into something that can make a serious amount of income, that?s the difficult part. Usually, by the time you?re running a successful business (if you make it that far), you realize your idea has been altered so many times it?s hardly the same idea at all.

?

Ideas are easy. But not at first. Here?s the distinction. Successful entrepreneurs say, ?Ideas are easy.? Meanwhile complete beginners would do almost anything to have a million dollar idea. The difference between these two groups is practice.

?

Having good ideas takes practice. And it takes a certain mindset ? a problem solving mindset. That?s what good entrepreneurs are: problem solvers. When they encounter an issue in their daily life, they solve it, and if possible, build a business designed to help others solve that same problem.

?

The non-entrepreneur goes shopping and says, ?man, I wish someone would figure out a way to get these carts unstuck.? The entrepreneur goes shopping and says, ?I?ll figure out a way to get these carts unstuck, then scale it.?

?

Entrepreneurs take responsibility. Everything rests on their shoulders. It?s never, ?what could someone else do.? It?s always, ?what could I do??

?

Mindset #2: Income is Tangible

?

Brand new entrepreneurs are full of optimism. And why shouldn?t they be? They?re starting down one of life?s most exciting paths. But too often, this optimism gets in the way. It gives them motivation at first, but eventually drags them down.

?

It?s not hard to hear entrepreneurial success stories. Just jump on your browser to read about the latest teenage whiz-kid millionaire. With headlines like ?sold for $10mm,? ?$100mm valuation,? ?$170k/mo at 19,? it?s easy to think money is raining from the sky.

?

Fresh entrepreneurs like to talk about all the stuff they?re going to buy when they ?make it.? They dream of fast cars, big houses, islands, yachts ? the whole nine yards.?

?

Yes, these mindsets can get you motivated. But business isn?t easy. Eventually you?re going to learn that?while it seems like everyone around you is making millions?money isn?t as easy to earn for entrepreneurs as the media makes it seem.

?

After a few months of trial and error in business, money becomes much more tangible. $10mm used to provoke the reaction of, ?that?s it?? Now making $2,000 /mo in a brand new business is cause for massive celebration (and it is).

?

Instead of focusing on all the stuff that?s awaiting in the future, successful entrepreneurs make goals. First $1,000. Then $10,000. Then $100,000. Each goal achieved makes the future goal possible. It?s no longer, ?I can?t wait until I get a Ferrari.? It?s, ?I?m going to work until I reach goal X.?

?

Mindset #3: Competition is not a Factor

?

So you?ve got an idea. Great! Now you realize how much work is ahead of you ? a daunting realization. But you?re still excited. So you do a Google search for your type of business. You think you?ve got a unique idea but you want to double check to make sure.

?

What?s this? A link you didn?t see before. A company doing almost exactly what your idea consists of. Too many aspiring entrepreneurs reach this point and give up. Someone?s already making a business out of your idea, where?s the room for you?

?

In reality, you should hardly even consider competition. No matter what someone is doing, you can find potential flaws in the business and create something that corrects those flaws. It doesn?t matter how well someone?s running a company ? there?s always room for improvement. And you can be that improvement.

?

It?s not about competing. It?s about taking what?s already out in the market and improving it. Remember, entrepreneurs are problem solvers. If you think a market is too crowded to get into, you?re thinking the wrong way. Even the most competitive markets have room for improvement. You can be the improvement and forge your own path. Then anyone who copies your ideas is competing against you (a competition you can easily win).

?

Mindset #4: Hard Work Equals Success

?

There?s still a misconception of ?luck? floating around the online business community. Some people think that if you don?t get lucky, you?re never going to create a successful business.

?

They?re right. But they?re looking at it the wrong way. We?ve all heard the quote, ?luck is when preparation meets opportunity.? So why hasn?t it sunk in yet??

?

Let me say this: I have never seen an entrepreneur who works all day, every day fail. Sure, I?ve seen them ?fail? ? that is, their current business didn?t do as well as they hoped. But they learn from that mistake and move on, continuing to work hard.?

?

The next business they start does a whole lot better. Maybe it?s not the gold mine, but it does well. Then they learn from that business and start the next one, which is a winner. Then everyone says ?oh, you just got lucky? without realizing there was a huge amount of hard work involved in the process.

?

When you work hard, you succeed. Sure, the payout may vary. One person may earn $10mm, the other may earn $100mm. But hard work will always lead to success.?

?

So many people refuse to get into the entrepreneurial game because of the luck factor. They?ve never been lucky, so why would they test their odds? If they realized how much that luck factor is in their control, they would be much more willing to put in the work necessary to make something happen.

?

But don?t delude yourself. Are you really working hard, or are you just telling people you work hard? Do you spend eight hours working on your business, or do you spend an hour on it and browse the web the rest of the time?

?

The results you get are directly related to the amount of work you put in. If you?re not getting good results, put in more work. But most importantly, learn from your work. Obviously, working eight hours a day on the same exact thing (if it?s not working) isn?t going to help you. But if you learn from your mistakes and past work, you can improve your efficiency and work smarter.

?

You Can Have These Mindsets

?

Now, there are people who will read this and think, ?sounds great, wish I was born with these mindsets.?

?

This is the key point: no one is born with these mindsets. You need to learn them. Sure, some people may have taken on these mindsets at a very early age. But that doesn?t mean it?s impossible for you to get them now.

?

It all depends on how badly you want it. If you adopt the mindsets listed above, you?ll be on the right path.

?

That might sound meaningless, but think about it. If you want to get to a specific destination, you need to be on the right path. Once you?re there, it?s a simple matter of traveling the distance between where you?re at and where you want to be.

?

That?s how entrepreneurship is. When you?re on the right path, you realize mindsets like ?9/10 businesses fail? are meaningless. You know that as long as you put one foot in front of the other, you?ll make it to your destination eventually.

?

SAN ANTONIO (AP) ? Closing arguments were planned Friday in the case of a Texas Air Force base instructor facing the most serious charges in a widening military sex scandal.

A seven-member jury of military personnel is hearing the court-martial of Staff Sgt. Luis Walker at Lackland Air Force base in San Antonio. Walker is accused of having illicit relationships with 10 women in basic training at the Lackland base, one of the nation's busiest military training centers.

He faces 28 counts, including charges of rape, aggravated sexual assault, obstructing justice and violating rules of professional conduct.

Lackland is where every American airman receives basic training. Walker is among 12 of the base's instructors being investigated for sexual misconduct toward at least 31 female trainees.

Six instructors have been charged on counts ranging from rape to adultery, and Walker is the first to stand trial. He also faces the most serious charges of all those accused ? making his case what prosecutors call a cornerstone of the larger investigation.

The alleged sexual misconduct at the base apparently began in 2009, but the first alleged victim didn't come forward until last year.

Prosecutors and defense attorneys both rested Thursday, after just three days of testimony.

Prosecutors called 14 witnesses, including one alleged victim who gave a video deposition because she had recently given birth and could not travel to the base.

On Tuesday, one alleged victim fought back tears as she testified that Walker lured her into his office and sexually assaulted her on a bed, ignoring her pleas for him to stop. She and others told jurors they were afraid that reporting Walker's actions would get them kicked out of the Air Force.

The Associated Press typically doesn't identify alleged sexual assault victims.

The defense called just one witness, Technical Sgt. Richard Capestro, who testified that instructors and trainees at the Lackland base are under constant surveillance and officials conduct surprise inspections of trainee dormitory areas without warning ? seemingly attempting to cast doubt on the possibility Walker could have committed rape and sexual assault on the premises.

Capestro said there are cameras in the hallways and at least some of the stairwells around base dormitories, and that open microphones allow an official on duty in a control room to push a button and listen in on any activity in the dorms.

Lackland has about 475 instructors for the approximately 35,000 airmen who graduate every year. About one in five is female, pushed through eight weeks of basic training by a group of instructors, 90 percent of whom are men.

Once the case goes to the jury, under Air Force court rules, its members consider each charge and can reach a guilty verdict on each with a simple two-thirds majority vote.

If Walker is found guilty on any charge, sentencing begins immediately and is also decided by the jury.

Hospital Employee Indicted for Causing Hepatitis C Outbreak

A New Hampshire hospital employee has been indicted for causing a Hepatitis C outbreak that infected 31 patients in the hospital's cardiac catheterization lab.

David Kwiatkowski, 32, was arrested and charged with acquiring a controlled substance by fraud and tampering with a consumer product with "reckless disregard" for the risk of others, according to an affidavit filed in U.S. District Court for the District of New Hampshire.

"The evidence gathered to date points irrefutably to Kwiatkowski as the source of the Hepatitis C outbreak at Exeter Hospital," U.S. attorney John P. Kacavas said in a press release. "With his arrest, we have eliminated the 'serial infector' posed to public and health safety."

The controlled substance was Fentanyl, an anesthetic more powerful than morphine. Kwiatkowski had allegedly been stealing the Fentanyl syringes intended for patients, injecting his own arm and then refilling those empty syringes with another liquid like saline, according to the press release.

Since Kwiatkowski tested positive for Hepatitis C in June 2010, he passed it on to the hospital patients, according to the affidavit.

Exeter Hospital employees discovered the outbreak in May 2012, prompting an investigation that spanned several local, state and federal government agencies, including the FBI, according to court documents obtained by ABCNews.com.

Investigators wrote that they suspect Kwiatkowski grabbed the loaded syringes when he brought lead aprons into the procedure room, into an area he didn't need to be inside at all. They suspect Kwiatkowski then replaced the Fentanyl syringes with saline syringes that were tainted with his strain of Hepatitis C.

Kwiatkowski was known for erratic behavior and suspected of abusing controlled substances, according to the affidavit. Other hospital employees said he would often sweat through his scrubs and made frequent trips to the bathroom.

One employee told investigators she saw "fresh track marks" when she tried to draw his blood. Another told investigators he remembered seeing Kwiatkowski with "a red face, red eyes and white foam around his mouth" during a shift at the lab.

Kwiatkowski also had a tendency to lie, employees told investigators. He told coworkers that he played baseball in college, and that his one-time fianc?e died "under tragic circumstances," neither of which were true. He also once excused bloodshot eyes by saying he was crying all night about a dead aunt who never existed.

When his roommate inquired about the needles in his laundry, Kwiatkowski told her he had cancer and was being treated at Portsmouth Regional hospital, according to the affidavit. Investigators found no documentation to prove this.

Kwiatkowski, who does not yet have a lawyer, was arrested this morning in Massachusetts, where he was being treated at a hospital. He faces up to 24 years in prison. Each offense could also result in a $250,000 fine.

Grounds for Appeal
Potential grounds for appeal in a criminal case include legal error, juror misconduct and ineffective assistance of counsel. Legal errors may result from improperly admitted evidence, incorrect jury instructions, or lack of sufficient evidence to support a guilty verdict. To grant the appeal, the appellate court must find that these errors affected the outcome of the case. If the errors would not have changed the verdict, they are considered harmless. A conviction may also be appealed if the defendant reasonably believes that the jury conducted itself improperly during deliberations or the trial itself. Jury misconduct includes the use of experiments, drug or alcohol abuse during deliberations or trial, and improper communications between jurors and witnesses or counsel. Finally, criminal defendants often appeal their cases when they feel that they were not provided with adequate representation. To succeed in an ineffective assistance of counsel claim, a defendants must typically prove that but for their counsel's actions, the outcome of the case would have been different.

Most decisions of a state or federal trial court (or an agency) are subject to review by an appeals court, including decisions regarding accident and injury cases. Whether the appeal concerns a judge's order or a final judgment entered by a jury, an appeals court reviews what happened in proceedings below for any errors of law. If the court finds an error that contributed to the trial court's decision, the appeals court will reverse that decision. The lawyers for the parties submit briefs to the court and may be granted oral argument. Once an appeals court has made its decision, the opportunity for further appeals is limited. The number of parties filing appeals has risen substantially in the last few decades, causing the state and federal court systems to implement changes in an effort to keep up.

Trials vs. Appeals
A trial and an appeal have a few similarities, but also many important differences. At trial, the parties present their cases, calling witnesses for testimony and presenting other pieces of evidence, such as documents, photographs, reports, surveys, diaries, blueprints, etc. The jury weighs this evidence and determines the facts of the case, that is, what they believe actually happened. A jury is therefore sometimes referred to as the finder of fact. The judge controls the activities in the courtroom and makes all the legal decisions, such as ruling on motions and on objections raised by the attorneys. The judge is often called the finder of law. If the parties have chosen a bench trial, rather than a jury trial, the judge will make both findings of fact and findings of law.

An appeal is a review of the trial court's application of the law. There is no jury in an appeal, nor do the lawyers present witnesses or, typically, other forms of evidence. The court will accept the facts as they were revealed in the trial court, unless a factual finding is clearly against the weight of the evidence.

Another difference between a trial and an appeal is the number of judges involved. A single judge presides over a trial. An appeal, however, is heard by several judges at once. How many depends on the jurisdiction. At the initial appeals court level, courts may have from three to a few dozen judges. Yet on the larger courts, the full number of judges seldom hear claims together. Instead, appeals are typically heard by panels, often comprised of three judges. In rare instances, the full court may decide to grant a motion for rehearing "en banc," in which event all the judges on the appeals court hear the case together and issue a new decision. Supreme courts, at the state and federal level, have from five to nine judges, referred to as justices.
